I think they have to be one skill point below the 6th star. And I think if you put them up for auction they are taken off the negotiation list. Also, I'm not sure if you'd see if your player was on the negotiation list.

I've got a question as well about negotiations:

Why or there some players on the neg list that I can't bid for? (There's no button)

If u buy try to add token buyer from higher level to your friends, they usually sell without a problem, player lose one star if the seller is up one level but u still enjoy 6 to 7 star for little token, if the seller is same level more often reject.
