yes, i believe it is illegal.
I would play a 3-0-3N-1-3 and hope for a goal-fest up the middle.

If you are worried about his DML/DMR coming up the flanks, go with:

He can park the bus, but if you play offensive and cover your butt, the 80/20 possession from the illegal formation, coupled with the offense, it should be a win for you.

His dmc is also a dc so I think he will change at the last moment his formation in 3N-4-1-2
What do you advice me? I think I will use 4-5-1 Vstyle or 3N-1(dmc)-3W-1.

4-5-1 Vstyle should work. Just make sure to attack by the flanks.
