Question about promotion in high level leagues

So..has anyone at a high level (above level 40) encountered a situation where they finish in a position to be promoted, but are not promoted? Any reasoning for this?

Not enough teams at that high level on that particular server to make up a league.

Often... There aren't enough teams.

It is also the same teams you start meeting over and over again. Same teams in Cup same teams in CL. And to top that, the auction list is suddenly reduced to only having 3 star players available and generated as new.......
