Thats not true. Playing out of formation is NOT an illegal formation.

Well I've certainly played against teams who have an otherwise legal formation, but have a player out of position and they've had 20% possession.

OOP does not result in 20% possession penalty. In your case, the OOP may have cost his team to only get 20% (I'm guessing this is the minimum as I've never seen an 18% or 17%). OOPs usually earns you 70% ++ possession.
