Cheating is using non-standard methods to create an advantage. He is using pretty standard method -- sitting straight and doing nothing. Tanking is not even an exploit, because it would be using bugs or doing something similar that game designers didn't intent a player to do. Tanking is part/a option of the game and the main reason of why the game still having this amount of old players.
Once everybody knows the rules, once everybody knows that 8 teams promote, once everybody knows how the game do the draws (cup and cl), once everybody knows that in many countries is posible to gather 30 greens per day, all this is part of the game and there's absolute freedom without considering the knowledge and use of these game factors as cheating, to play as one wants.
This freedom to come again when one wants is a point too, and stay without CL in exchange of a training season -unless you win the SL as I did lol- too is fair, has been always my opinion since I started again with Bayern in 2013.

Since the system creates leagues with similar AvQ teams this is something that can be neutralized in the lower levels, in the top ofc is more complex.
